It's not a matter what you think should be the law. The law says that it is illegal for you to steal. You are stealing music when you download a copywrited song (that has not been officially distritbuted for free).

What the RIAA does is wrong however. If the RIAA catches you downloading warez, music or other stuff like that, they will pin your IP and then go to your ISP and ask you for your information. (Phone, home address, etc.) That's an invasion of privacy. That's why ISP like PacBell (SBC) are fighting against the RIAA because of that reason alone.

They were sued successfully by Sharman (I think thats how you spell it) for using illegal programs of Kazaa. Basically they are hacking your computer to get your ip in that case they are breaking the law. So... FUCK RIAA...

I agree that downloading things is illegal, but I also think that the RIAA is going over the top with their measures.

Basically it's like this. If you have been caught downloading illigal materials, Companies CAN NOT go to your ISP and ask for information unless they go through a law enforcement agency (police, lawyer etc.) and get a warrant. Once that is done, however, they can get personal information, and when given another warrant, they can search your PC. If all they have is the fact you downloaded something, they can not persue charges if they did not find the downloaded material in your posession (either on your computer or already transferred to a CD). The big issue here though is the means they are going about to get that information. I have not comfirmed this, but what I have heard is that they are offering a music/file sharing program that is spyware (once agaan, I have NOT confirmed this, so don't quote me on it). This is illigal unless it has been sanctioned by the courts (The same reason the police can not tap your phone without a warrant). They can try all they want, but without the actual file to go on, the chances of you getting charged is very low, though not impossible. If you downloaded a song simply to sample it (Hint, hint: possible legal defence alert) and then delete it, it could be successfully argued that the artist lost no money, and infact have the possibility to gain money now that you know you will enjoy the song once purchased. Keep in mind though, they have your IP and can get you on copywrite infringement for simply downloading it, but without the program in your posession the severity of the charge, if any will most likely be lower.

If anyone finds any problems, please post as I may have missed a point.

Warrant, the RIAA doesn't care about what you 'download,' in fact, they have no reasonable way right now to even know that information. What they care about is what you 'share' with the public.

They use the same programs that everyone else does to search for all of their music online. They have a list of X number of songs that they consider to be high profile, copyrighted, and want to persue..

They simply do a search for this music and find users that are offering them. If they find them, they may query that user to see what else they have and make a list.

By simply starting a download from that user, they can get the users IP, and all their data collection is complete. You can't argue that they are breaking the law by downloading the music, as they own the copyrights to the songs.

They use this information of what songs you have and throw it in to some algorythm that tells them how many people have 'possibly' downloaded and re-shard this file from you, and that is where the enormous fines come in to play. I share it with two friends, they share it with two friends, they share it with two friends, on and on and on.. By assuming the song has now gone to 3,000 people, all originating from your machine, you now owe us $150,000

Simple solution, download like a mofo, and don't share shit.. at least for now.. I'm sure they will find a way to rectify that problem in the future, but it's one hurdle at a time.

It's similar to the drug dealer and the drug user.

The cops want the dealer, not the user. The people sharing the files are the dealers, those downloading them anre the users. The cops use the users and a lot of times play the role of a user to catch the dealers. The RIAA does a similar thing. They portray the role of the user to find the dealers. When they get enough "Goods" off the dealers they move in for the kill. Simple sting.
